SEC seeks $3 million penalty against former Western Asset executive Leech

The proposed judgment requires court approval. The SEC says it would bring combined investor relief from Leech and Western Asset to $103 million.

Leech’s proposed SEC judgment awaits court approval

The Securities and Exchange Commission (SEC) asked a court on October 6, 2026, to approve a judgment imposing a $3 million penalty on Stephen Kenneth Leech II. He is the former co-chief investment officer of Western Asset Management Company LLC.

Leech agreed to the proposed civil judgment without admitting the SEC complaint’s allegations. The agreement remains subject to court approval.

The judgment would also bar him from serving as an officer or director and permanently prohibit violations of federal securities antifraud laws. Separately, the SEC says Leech agreed to a forthcoming associational bar, a restriction on professional affiliations.

How trade timing allegedly shifted gains and losses

The SEC’s November 2024 complaint centers on trade allocation: deciding which investment portfolio receives a trade. It alleges that Leech delayed those decisions from at least January 2021 through October 2023.

According to the complaint, Leech waited until near or after daily futures settlement prices—the day’s pricing reference points—were set. That allowed him to observe price movements before assigning trades to portfolios, the SEC alleged.

The SEC alleges that favored portfolios received a disproportionate share of hundreds of millions of dollars in first-day gains. These included realized gains, or booked profits, and unrealized gains, or increases in value not yet booked. Disfavored portfolios allegedly received a similar amount of first-day losses.

The alleged harm therefore concerns which portfolios received profitable and losing trades. Leech’s consent to the proposed judgment does not amount to an admission of those allegations.

The obstruction plea concerns testimony to investigators

On June 12, 2026, the Department of Justice announced that Leech had pleaded guilty to one count of obstruction of justice. The offense involved false and misleading testimony to the SEC.

That documented guilty plea concerns his testimony. It is separate from the civil trade-allocation allegations, which he did not admit in agreeing to the proposed SEC judgment.

Investor relief builds on Western Asset’s $100 million settlement

In June 2026, the SEC settled administrative proceedings against Western Asset and ordered a $100 million civil penalty. It also established a Fair Fund, a fund intended to distribute money to affected investors in the disfavored portfolios.

The SEC says that settlement and Leech’s proposed resolution would together return $103 million to harmed investors if the court approves his judgment. Court approval is the remaining condition identified for that combined amount; the statement does not establish that investors have received payments.
